VIGO COUNTY AREA PLAN COMMISSION HEREBY GIVES CERTIFICATION TO
RESOLUTION
NUMBER 4, 1998

Dear Members:
The Vigo County Area Plan Commission offers you the following Resolution and Certification of Resolution Number 4, 1998:
A RESOLUTION BY THE AREA PLANNING COMMISSION OF VIGO COUNTY, INDIANA, RECOMMENDING THAT THE VIGO COUNTY BOARD OF COMMISSIONS, THE COMMON COUNCIL OF THE CITY OF TERRE HAUTE, THE TOWN BOARD OF RILEY, THE TOWN BOARD OF SEELYVILLE, AND THE TOWN BOARD OF WEST TERRE HAUTE HEREBY AMEND THE UNIFIED FLOODPLAIN CONTROL ORDINANCE ALSO KNOWN AS CHAPTER 102 OF THE VIGO COUNTY CODE AND SECTION FIFTEEN OF THE UNIFIED ZONING ORDINANCE.
WHEREAS, the Unified Floodplain Control ordinance will promote the public health, safety, convenience, and general welfare of the citizens of Vigo county and otherwise accomplish the purposes of IC 36-7-4; and
WHEREAS, the Unified Floodplain Control Ordinance was properly adopted originally in 1983 and amended in 1994; and
WHEREAS, the Department of Natural Resources Division of Water recently conducted their scheduled Community Assistance visit and advised the Director of six amendments of our Unified Floodplain Control Ordinance that needed to remain in compliance; and
WHEREAS, the Area Plan Director has initiated and drafted the required
amendments which consist of the following:
Section 3.B.2.a., delete the words "valued at more than $1,000".
Section 6.A.2.a., delete "Under the provisions of IC 13-2-22", add "Under the provisions of IC 14-28-1."
Section 6.A.2., add the following: "d. If the site is in an identified floodplain where the limits oŁ the floodway and floodway fringe have not yet been determined and the drainage area upstream of the site is less than one square mile, the Director shall require the applicant to provide an engineering analysis showing the limits of the floodway, floodway fringe and 100 year elevation for the site.
Upon receipt, the Director may issue the local Improvement Location Permit, provided the provisions contained in Sections 7 and 8 of this ordinance have been met."
Section 8.A.1.a., Delete "...valued at more than $1,000; or greater than 400 square feet, whichever is less." add: "...having a floor area greater than 400 square feet."
Section 8.A.1.b., Delete "structural alterations made to an existing building that increase the market value of the building by more than 505 (excluding the value of the land)", add in its place "b. structural alterations made to: 1. an existing (previously unaltered) building, the cost of which equals or exceeds 50% of the value of the pre-altered building (excluding the value of the land)”. “2.any previously altered building."
Section 8.A.1.c., Delete "any subsequent alterations".
WHEREAS, said resolution was written to satisfy the Department of Natural Resources, Division of Water recommendations; and
NOW, THEREFORE, BE IT RESOLVED, that the Area Plan Commission of Vigo County, Indiana, hereby certifies that said Commission makes a favorable recommendation to the Vigo county Board of Commissioners, the Common Council of the City of Terre Haute, the Town Board of Riley, the Town Board of Seelyville, the Town Board of West Terre Haute, that the above Unified Floodplain Control Ordinance amendments be adopted.
