CHAPTER 83

 

COUNTY ROAD 129 LOAD LIMIT ORDINANCE

 

 

5 – 83.1      Purpose

The purpose of this ordinance is to preclude unnecessary damage to County Road 129 (commonly known as the Pimento/Blackhawk Road), due to certain vehicles carrying unnecessarily heavy loads on said County Road 129.

 

5 – 83.2      General Provisions

      Any person or persons who operates, drives, or directs a motor vehicle upon County Road 129 (commonly known as the Pimento/Blackhawk Road) carrying a load in excess of 24,000 pounds, shall be guilty of violating this ordinance.

 

5 – 83.3      Penalties

Any person found guilty of violating this Ordinance under Section 11 shall be fined in the amount of Two Hundred and Fifty ($250.00) Dollars far his first violation; should said person be found guilty of committing a second offense, he shall be fined in the amount of Five Hundred ($500.00) Dollars; and should said person be found guilty of any subsequent violations he shall be fined in the amount of One Thousand ($1,000.00) Dollars for each subsequent violation.

 

5 – 83.4      Repealer

All Ordinances or parts of Ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

5 – 83.5      Severability Clause

If any section, provision, or part of this Ordinance is adjudged invalid oz unconstitutional, such adjudication shall riot effect the validity of the Ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.

 

5 – 83.6      Effective Date

Passed and adopted by the Vigo County Board of Commissioners on the 1st day of May, 1984.
