CHAPTER 81

ROAD RIGHT-OF-WAY PERMIT ORDINANCE

5 – 81.1      Purpose

To establish requirements pertaining to encroachment on road right of ways within Vigo County.

5 – 81.2      Right-of-Way Permits

      Any contractor or individual who wishes to make a cut or opening in a county road right of way shall obtain a permit approved by the Board of Commissioners of Vigo County.

5 – 81.3      Permit Fees

5 – 81.3-a      There shall be a charge of one Dollar ($1.00) for each permit issued.

5 – 81.3-b      Said contractor or individual shall provide a bond to cover any damage that might occur during the operation and a guarantee that the road will be back filed and put back in proper condition.

5 – 81.4      Repealer

      All ordinances or parts of ordinances in conflict with the previsions of this ordinance are hereby repealed.

5 – 81.5      Severability Clause

      If any section, provision, or part of this ordinance is adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.

5 – 81.6      Effective Date

      Passed and adopted by the Beard of Commissioners of Vigo County on May 15, 1969.
