CHAPTER 74

 

FIRE PROTECTION DISTRICT

FOR SUGAR CREEK TOWNSHIP

 

 

4 – 74.1      Purpose

      An ordinance establishing a fire protection district in Sugar Creek Township, County of Vigo, State of Indiana, in order to provide greater fire protection services within the aforementioned area, and a Board of Fire Trustees to execute the powers and duties granted said Trustees in accordance with I.C.

36-8-11-1, et. seq..

 

4 – 74.2      Definitions

      As used in this Ordinance, unless the context clearly denotes otherwise, these terms shall have the following meaning:

4 – 74.2-1      "Board" refers to the Board of Fire Trustees of the Sugar Creek

Township Fire Protection District.

4 – 74.2-2      Commissioners" refers to the Board of Commissioners of Vigo County, Indiana.

4 – 74.2-3      "Sugar Creek Township Fire Protection District" shall mean that

territory within Sugar Creek Township, of the County of Vigo, State of Indiana, including the Town of West Terre Haute, State of Indiana.

 

4 – 74.3      General Provisions

4 – 74.3-a      The Commissioners, pursuant to the provisions of I.C. 36-8-11-1, et. seq., hereby establish the Sugar Creek Township Fire Protection District.

4 – 74.3-b      Pursuant to I.C. 36-8-11-12, the Commissioners shall appoint five (5) Trustees to serve on the Board.

4 – 74.3-c      The initial Board shall be comprised as follows:

4 – 74.3-c.1      David Bell far a term of one (1) year

4 – 74.3-c.2      Pat Michl for a term of two (2) years

4 – 74.3-c.3      Robert Garzolini for a term of three (3) years

4 – 74.3-c.4      David Tatum for a term of four (4) years

4 – 74.3-c.5      Rick Wheat for a term of four (4) years

4 – 74.3-d      The terms expire on the first Monday of January of the year that the Trustees' appointments expire. As the terms expire, each new appointment is for a term of four (4) years.

4 – 74.3-e      The Commissioners hereby incorporate by reference all of those provisions contained within I.C. 36-8-11-1, et, seq..

 

4 – 74.4      Repealer

      All Ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.

 

4 – 74.5      Severability Clause

Should any section, paragraph, cause, or phrase of this Ordinance be declared unconstitutional or invalid, the remainder of said ordinance shall continue in full force and effect.

 

4 – 74.6      Effective Date

      This Ordinance shall be in full force and effect upon its passage by the

Commissioners on February 27, 1995.
