CHAPTER 70

 

FIRE PROTECTION DISTRICT FOR HONEY

CREEK TOWNSHIP, VIGO COUNTY, INDIANA

 

 

4 – 70.1      Purpose

An ordinance establishing a fire protection district in Honey Creek Township, County of Vigo, State of Indiana, in order to provide greater fire protection for the aforementioned area, financial stability for the fire protection services within the aforementioned area, and a Board of Fire Trustees to execute the powers and duties granted said Trustees in accordance with I.C. 36-8-11-15.

 

4 – 70.2      Definitions

      As used in this Ordinance, unless the context clearly denotes otherwise, these terms shall have the following meaning:

4 – 70.2-1      "Board" refers to the Board of Fire Trustees of the Honey Creek Fire Protection District.

4 – 70.2-2      "Honey Creek Fire Protection District” shall mean that territory within Honey Creek Township, of the County of Vigo, State of Indiana, except that territory previously annexed to the City of Terre Haute, County of Vigo, State of Indiana.

 

4 – 70.3      General Provisions

4 – 70.3-a      The Board of County Commissioners of Vigo County, Indiana, pursuant to the provisions of I.C. 36-8-11-12. et seq. hereby establishes the Honey Creek Township Fire Protection District.

4 – 70.3-b      Board of Trustees. Pursuant to I.C. 36-8-11-12, the Board of County Commissioners of Vigo County, Indiana, shall appoint five (5) Trustees to serve on the Board. The Board of County Commissioners of Vigo County, Indiana, shall

specify that one (1) of the aforementioned Trustees shall serve a term o£ one (1) year, one (1) of the aforementioned Trustees shall serve a term of two (2) years, one (1) of the aforementioned Trustees shall serve a term of three (3) years, and two (2) of the aforementioned Trustees shall serve a term of four (4) years. 4 – 70.3-c      The Board of County Commissioners of Vigo County, Indiana hereby incorporates by reference all thane provisions contained within I.C. 36-8-11-1 et seq.

 

4 – 70.4      Repealer

      All Ordinances or parts of Ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

4 – 70.5      Severability Clause

      Should any section, paragraph, clause or phrase of this ordinance be declared unconstitutional or invalid, the remainder of said Ordinance shall continue in full force and effect.

 

4 – 70.6      Effective Date

      Passed and adopted by the Vigo County Board of Commissioners this 6th day of August, 1984.
