CHAPTER 51

 

AN ORDINANCE ESTABLISHING DESIGNATION OF

HUMANE SOCIETY TO RECEIVE DOG TAX PAYMENT

 

 

3 – 51.1      Purpose

      Whereas, Indiana Code 15-5-9-8(a) provides that the money derived from taxing dogs shall constitute a township dog fund to be used for the payment of damages caused by dogs; and

      Whereas, Indiana Code 15-5-9-8 subsections (d) and (e) provide that a county legislative body may designate by ordinance one (1) humane society located in that county to receive fifty cents ($0.50) from each dog tax payment collected under I.C. 15-5-9 and that a humane society so designated shall use the funds so disbursed to the society to maintain an animal shelter; and

      Whereas, the Terre Haute Humane Society provides an animal shelter in Vigo County.

 

3 – 51.2      General Provisions

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the County of Vigo, State of Indiana:

3 – 51.2-1  The Terre Haute Humane Society is designated to receive fifty cents ($0.50) of each dog tax payment collected by a Vigo County Township Assessor or a Township Trustee who has the duties of a Township Assessor, pursuant to I.C. 15-5-9.

3 – 51.2-2      The payment of the specified amounts to the Terre Haute Humane Society shall be made from the county dog fund on the second Monday in March of each year after the transfer of the dog tax funds from the township to the County as provided in I.C. 15-5-9-10(e) and (f).

3 – 51.2-3      The Terre Haute Humane Society shall use the funds so received to maintain its animal shelter.

 

3 – 51.3      Repealer

All Ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

3 – 51.4      Severability Clause

If any section, provision, or part of this ordinance is adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional.

 

3 – 51.5      Effective Date

This ordinance has been passed and adopted this 28th day of May, 1996 by the Vigo County Board of County Commissioners.
