CHAPTER 28

 

AN ORDINANCE ESTABLISHING A VIGO COUNTY CORRECTIONS FUND

 

 

2 – 28.1      Purpose

Whereas, Senate Enrolled Act No. 395, passed by the General Assembly during regular session of the Indiana Legislature in 1986, et seq. provides for the establishment and funding of a County Corrections Fund; and

Whereas I.C. 11-12-6-6 provides that any county may annually adopt an ordinance to elect to receive deposits from the State Department of Corrections and establish a County Corrections Fund, and

Whereas, the County Corrections Fund may be used only for Community Corrections facilities and programs; and

Whereas, the County in concurring with this Ordinance may elect to receive deposits under I.C. 11-12-6-13 from the State Department of Corrections Fund and receive deposits at either Level I, Level II or Level III Funding; and

Whereas, Level III is the most appropriate level of participation for Vigo County;

 

2 – 28.2      General Provisions

NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE VIGO COUNTY COMMISSIONERS, as follows:

2 – 28.2-1      The Vigo County Auditor is hereby authorized to receive deposits from the State Department of Corrections in accordance with I.C. 11-12-6 et seq. as the Vigo County Commissioners shall by this Ordinance elect to receive same in accordance with said statute;

2 – 28.2-2      That Vigo County does hereby elect to receive deposits at Level III Funding.

2 – 28.2-3      That there is hereby created a "Vigo County Corrections Fund" to be administered by the Vigo County Council as the County fiscal body. The Fund shall consist of deposits received from the Indiana Department of Corrections in accordance with I.C. 11-12-6, et seq..

2 –28.2-4      The Vigo County Corrections Fund may be used only for funding local correctional facilities and programs. Any monies remaining in the Vigo County Corrections Fund at the end of the year shall not revert to any other fund but remain in said Vigo County Corrections Fund for use as specified in the statute regarding same as herein above set forth, and shall not require a notice of encumbrance but retention shall be automatic and in accordance with Title XI of the Statutes of the State of Indiana.

 

2 – 28.3      Effective Date

      This Ordinance has beers passed and adopted this 30th day of March, 1999.
