CHAPTER      26

YARD  SALE       ORDINANCE

2 – 26.1      Purpose

This Ordinance shall be known and may be cited as the Vigo County Yard Sale Ordinance.

2 – 26.2      General Provisions

2 – 26.2-a      Any person selling personal items in a yard or garage sale may do so upon their own premises not to exceed four (4) in one calendar year; each sale no more than three (3) consecutive days.

2 – 26.2-b      Any signs posted on telephone poles, in yards, or in any other public place shall be placed 24 hours before and removed 24 hours after said sale.

2 – 26.2-c      This provision does not apply to bona fide businesses or to the sale of motor vehicles or boats.

2 – 26.2-d      Violation of this Ordinance will result in a fine of up to One Hundred Dollars ($100.00) for each day or any part of a day of non-compliance.

2 – 26.3      Repealer

      All Ordinances or parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed.

2 – 26.4      Severability Clause

If any section, provision, or pair of this Ordinance is adjudged invalid or unconstitutional, such adjudication shall not effect the validity of the ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.

2 – 26.5      Effective Date

      Passed and adopted by the Board of Commissioners of Vigo County Indiana, on this 31st day of July, 1995.
