CHAPTER 21

SERVICE FEES FAR PERSONAL CHECKS & DRAFTS

2 – 21.1      Purpose

      This ordinance shall be known and may be cited as the Bad Check and Draft Service Charge Ordinance.

2 – 21.2      Definitions

Far the purpose of this Ordinance, the following terms, phrases, words, and their derivations, shall have the meaning given herein. When not inconsistent with the context, words used in the present tense included the future, words in the plural include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.

2 – 21.2-1      "County" is the County of Vigo in the State of Indiana.

2 – 21.2-2      "Check or Draft" is a three-party instrument with a drawer, a drawee, and a payee.

2 – 21.2-3      "Return Check or Draft" is a three-party negotiable instrument which has been returned to the payee due to insufficient funds in the drawer's account or because the drawer's account has been closed or because the drawer has stopped payment on said check or draft.

2 – 21.3      Grant Of Authority

      The Vigo County Treasurer’s Office shall charge a service fee of $20.00 against the drawer of any check or draft which is returned to the Vigo County Treasurer’s Office when the payee on said check or draft is the County of Vigo or a department of the governmental entity of the County of Vigo.        1995

2 – 21.4      Repealer

      All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

2 – 21.5      Effective Date

A.    Passed and adopted by the Board of Commissioners of Vigo County on August 26th, 1985.
