VIGO COUNTY MEDICAL CARE FOR INMATES FUND
1 – 16.1
Purpose
1 – 16.1-a This ordinance shall be known and may be cited as the Vigo County Medical Care for Inmates Fund.
1 – 16.1-b The purpose of the establishment of this Fund shall be to comply with Indiana Code 11-12-5-5.
1 – 16.2
General Provisions
1 – 16.2-a This Section does not apply to a person confined to the Vigo County Jail who:
1 – 16.2-a.1 Maintains a policy of insurance from a private company covering:
1 – 16.2-a.1-a Medical care;
1 – 16.2-a.1-b Dental care;
1 – 16.2-a.1-c Eye care; or
1 – 16.2-a.1-d Any other health care related service;
1 – 16.2-a.2 is willing to pay for the person's own medical care; or
1 – 16.2-a.3 is committed to the department of correction.
1 – 16.2-b Except as provided in subsection (C), a person confined to the Vigo County Jail shall be required to make a co-payment in an amount of not more than Ten Dollars ($10.00) for each provision of any of the following services:
1 – 16.2-b.1 Medical care;
1 – 16.2-b.2 Dental care;
1 – 16.2-b.3 Eye care; or
1 – 16.2-b.4 Any other health care related service.
1 – 16.2-c A person confined to the Vigo County Jail is not required to make the co-payment under subsection (B) if:
1 – 16.2-c.1 the person does not have funds in the person's commissary account or trust account at the time the service is provided;
1 – 16.2-c.2 the person does not have funds in the person's commissary account or trust account within thirty (30) days after the service is provided;
1 – 16.2-c.3 the service is provided in an emergency;
1 – 16.2-c.4 the service is provided as a result of an injury received in the Vigo County Jail; or
1 – 16.2-c.5 the service is provided at the request of the sheriff or jail administrator.
1 – 16.2-d Any money collected pursuant to this Ordinance shall be deposited into the Vigo County Medical Care for Inmates Fund.

Repealer
All ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
1 – 16.4
Severability Clause
If any section, provision, or part of this Ordinance is adjudged invalid or unconstitutional, such adjudication shall not effect the validity of the. ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.

Effective Date
Passed and adapted by the Board of Commissioners of Vigo County, Indiana, on this 3rd day of October, 1994.
