Chapter 12

ESTABLISHMENT OF THE VIGO COUNTY REDEVELOPMENT  COMMISSION

1 – 12.1  PURPOSE

      WHEREAS, the Indiana Code 36‑7‑14‑3, Section A (1), states "A unit may establish a Department of Redevelopment by a board of five members being known as "VIGO COUNTY REDEVELOPMENT COMMISSION°, designating the name of the municipality or county;

      WHEREAS, the Indiana Code 36‑7‑14‑2.5, Section 2.5 (a) states as follows: "The planning, replanning, development and redevelopment of economic development areas of public and government functions that cannot be accomplished through the ordinary operations of private enterprise because of:

1 – 12.1-1 The necessity for acquiring the proper use of the land so as to best serve the interest of the county and its citizens; and

1 – 12.1-2 The cost of these projects; and

      WHEREAS, the Indiana, Code 36‑7‑14‑2.5, Section 2.5 (b) the planning replanning, development, and redevelopment of economic development areas will:

1 – 12.1-3 Benefit the public health, safety, morals and welfare;

1 – 12.1-4 Increase the economic well‑being of the unit and the state;

1 – 12.1-5 Serve to protect and increase property values in the unit and the state; and

      WHEREAS, the Indiana Code 36‑7‑14‑2.5, Section 2.5 (c) the planning, replanning, development and redevelopment of economic development areas under this Chapter are public uses and purposes for which public money may be spent and property may be acquired; and

      WHEREAS, that there is a need in Vigo County for assistance in the planning, replanning and development, and redevelopment of economic development areas for public and governmental function;

1 – 12.2 GENERAL PROVISIONS

      NOW THEREFORE, BE IT ORDAINED AND ENACTED by the County of Vigo, State of Indiana:

1 - 12.2-1 That there shall be and hereby is, created and established a department of redevelopment controlled by a board of five members to be known as "VIGO COUNTY REDEVELOPMENT COMMISSION".

1 – 12.2-2 The five commissioners for the county redevelopment commission shall be appointed by the county executive in accordance with the Indiana Code 36‑7‑14‑6.1 (b).

1 – 12.2-3 That all staff positions, if any, be appointed by the Board of Commissioners of Vigo County and shall serve at the pleasure of the Vigo County Commissioners and salaries shall be set by the County Council of Vigo County.

1 – 12.2-4 That said county redevelopment commission shall be responsible for planning, replanning, development and redevelopment of economic development areas for public and governmental functions and other functions as provided by law.

1 – 12.3  REPEALER

A. All Ordinances or parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed.

1 – 12.4 SEVERABILITY CLAUSE

A. If any section, provision, or part of this Ordinance is adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional.

1 – 12.5 EFFECTIVE DATE

A. Passed and adopted by the Vigo County Council of Vigo County this 12th day of April, 1988.

B. Passed and adopted by the Vigo County Board of Commissioners this 8th day of July, 1988.
