CHAPTER 10

BOARDS AND COMMISSIONS

 

 

1 – 10.1      Tourism Commission

1 – 10.1-a      The Vigo County Council, pursuant to Public Law 65 of the 1980 Session of the Indiana Legislature and also known as Indiana Code 6-9-11-1, through and including 6-9-11-8, does hereby establish a tourism commission. Said tourism commission is to have all powers and responsibilities as provided by Indiana law.

 

1 – 10.1-b       In addition the tourism commission shall submit an annual budget to the Vigo County Council in the same manner and time as other county agencies and said budget will be adopted only as approved by the Vigo County Council. Should the revenue generated by said tourism commission be in excess of one hundred and

twenty-five thousand ($125.000.00) dollars for the budget year then the salaries

for said tourism commission shall not exceed thirty (30%) percent of the total

revenue. In the event that the revenue for the budget year is less than one

hundred and twenty-five thousand ($125.000.00) dollars, then the percent of the revenue represented by salaries shall be within the discretion of the commission, subject to the approval of the Vigo County Council.       11/15/83

 

1 – 10.1-c      Passed and adopted by the Vigo County Council on June 4, 1980.

 

1 – 10.2      Private Industry Council*

1 – 10.2-a      Whereas the "Comprehensive Employment and Training Act of 1973" (CETA) enacted by the 93rd Congress of the United States on December 29, 1973 (Public Law 93-203) has been amended October 27, 1978 (Public Law 95-524); to mandate the creation of a Private Industry Council (PIC) for the administration of Title VII.

 

1 – 10.2-b      The Vigo County PIC is to be composed of no less than 51% private sector members to ensure business and industry input into the training programs; and by increasing the Planning Council private sector membership to no less than 51%, all titles shall receive the benefit of business and industry input into all training programs; and this combination of both Planning Council and Private Industry Council necessitates an agency name change to facilitate this change in direction.

 

1 – 10.2-c      The Board of Commissioners of Vigo County has hereby changed the composition of the Planning Council to be no less than 51% private sector members and has changed the name of the Vigo County Bureau of Employment and Training to Private Industry Council of Vigo County.

 

1 – 10.2-d      Passed and adopted the Vigo County Board of Commissioners on October 1, 1981.  *(See Section 1-9-1).

 

1 – 10.3      Housing Authority

1 – 10.3-a      Pursuant to the Housing Authorities Act, as amended, the County Council of the County of Vigo, Indiana, upon due notice having held a public hearing whereat an opportunity to be heard was granted to all residents and taxpayers of the County and to all other interested persons, having considered the testimony and evidence presented at said public hearing and their own personal knowledge of dwelling accommodations and need for a housing authority, the County Council of the County of Vigo, Indiana, hereby finds, determines and declares that:

1 – 10.3-a.1      Unsanitary and unsafe inhabited dwelling accommodations exists in the County of Vigo, Indiana

1 – 10.3-a.2      There is a shortage of safe and sanitary dwelling accommodations in the County of Vigo, Indiana, available to persons of low income at rentals they can afford

1 – 10.3-a.3      There is need for a housing authority to function in the County of Vigo, Indiana.

 

1 – 10.3-b      The name of said housing authority shall be Housing Authority of the County of Vigo.

 

1 – 10.3-c      Passed and adopted by the Vigo County Council on November 25, 1980.

 

1 – 10.4      Hospital Authority

1 – 10.4-a      The IC 1971, 5-1-4-1 et. seq., as amended and supplemented, known as the "Indiana Hospital Authority Act" (the "Act"), provides that the Board of County Commissioners of any county in which there is located one or more "participating hospitals" (as defined in the Act), upon request in writing by the board of trustees or other governing board of any such participating hospital, may adopt a resolution for the creation of an authority under the provisions of the Act.

 

1 – 10.4-b      The Board of Directors of Union Hospital, a not-for-profit

corporation organized under the laws of the State of Indiana and located in Terre Haute, which is a "participating hospital" within the meaning of the Act, has filed a request in writing with the Board of Commissioners of Vigo County, Indiana for the creation of an authority under the provisions of the Act.

 

1 – 10.4-c      This Board of Commissioners hereby finds that for the benefit of the people of the State of Indiana and the County of Vigo, the increase of their commerce, welfare and prosperity and the improvement of their health and living conditions, it is essential that hospitals within the County of Vigo be provided with appropriate means to expand, enlarge and establish health care, hospital and other related facilities which are needed in the County of Vigo, all to the public benefit and good.

 

1 – 10.4-d      The Board of Commissioners of the County of Vigo, Indiana, do hereby create, pursuant to the Act, the "Hospital Authority of Vigo County, Indiana", which shall be a body corporate and politic for the purpose of assisting participating hospitals in the construction, financing and refinancing one or more projects (as defined in the Act) located in Vigo County, or refunding outstanding indebtedness of participating hospitals located in Vigo County as authorized by the Act and to have all the powers now or hereafter granted to an authority under the Act.

 

1 – 10.4-e      Passed and adopted by the Vigo County Board of Commissioners on October 25, 1977.

 

1 – 10.5      Sheriff's Merit Board

1 – 10.5-a      There is hereby established, pursuant to I.C. 36-8-10-3 the Vigo County Sheriff's Merit Board.

 

1 – 10.5-b      There shall be five (5) members of said Vigo County Sheriff's Merit Board and said members shall be appointed or elected in accordance with I.C. 36-8-10-3 (b).

 

1 – 10.5-c      The Vigo County Sheriff's Merit Board shall meet monthly pursuant to I.C. 3-8-10-3 (c), in order to transact the business of the Sheriff's Department.

 

1 – 10.5-d      This ordinance shall be of full force-and effect thirty (30) days after its passage and during the interim said members of the Vigo County Sheriff's Merit Board shall be appointed or elected in accordance with Section II of this ordinance.

 

1 – 10.5-e      Passed and adopted by the Vigo County Board of Commissioners on

August 15th, 1983.
